This document regulates the terms and conditions under which you are entitled to access and use the services of the website roly.cl and of any information, text, video or other material communicated on the website.

On this Web site you may use, free of charge, software and applications for mobile devices that allow you to browse, visit, compare and, if you wish, purchase the goods or services displayed here.

We recommend that you read these terms and conditions carefully and print or save a copy of these terms and conditions on your local disk drive for your information.

These Terms and Conditions shall be applied and shall be understood to be incorporated in each of the contracts you enter into with Roly Chile through this website.

The use of this website, the application of these Terms and Conditions, the acts you execute and the contracts you enter into through this website, are subject to and subject to the laws of the Republic of Chile and especially to law 19.496 on the protection of consumer rights.

Roly Chile, therefore, will strictly apply all the benefits, guarantees and rights recognized in favor of consumers in Law 19.496.

Medina Ricci.

Roly Chile undertakes that, in case of sending you advertising or promotional information by e-mail, it will contain at least the following information:

a) Identification of the message, which makes it recognizable as advertising or promotional communication, in the subject field of the message.

b) Existence of the consumer's or user's right to request the cessation of such advertising sent by Roly Chile and Roly Chile's obligation to suspend such mailings.

c) A simple and effective procedure for the consumer to make such a request, indicating an e-mail address for this purpose.

d) Identification of the advertiser with its trade name.

In the case of teaser advertising, the obligations set forth above shall be complied with to the extent that the agency carrying out the same is identified.

Roly Chile will cease sending advertising or promotional messages by e-mail or other equivalent means of individual communication to any person who has expressly requested the suspension of such mailings.

The mere visit to this site does not impose any type of obligation on the user, unless the user unequivocally expresses, by means of positive acts, his or her willingness to contract with the company to acquire goods or services, in the manner indicated in these terms and conditions.

To accept these Terms and Conditions, the user must click where the Roly Chile website offers this option in the user interface with the sentence "I have read and accepted" or other equivalent that allows you to give your unequivocal consent to the acceptance.

Registration on the site and the use of a password is a mandatory requirement for contracting, facilitating personalized, confidential and secure access to the site.

In case of registering in the site, the user will have a secret password which can be used and even modified if required by the user. To activate the password, the user must complete the registration form available on the site and send it to Roly Chile by clicking on the respective field.

The user and the administrator shall be responsible for the confidentiality of the password within the scope that corresponds to each one of them.

Roly Chile sells products that may be purchased by persons over 18 years of age (adults) through any of the electronic payment methods available on the site. If you are under 18 years of age, you may use this site only through your parents or legal representative.

To make purchases or contract services in this site you must follow the following steps by clicking on the corresponding field:

1. To start the contracting process it is necessary that you confirm that you have read and accepted these Terms and Conditions.

2. Select the product or service you are interested in and add it to your "shopping cart.

3. Login to the site or Enter your email and password. And, in case you are not registered and wish to do so, use the user panel located at the top right of the site.

4. Select the type of shipment, delivery among the alternatives available on the site, enter or verify your shipping and/or pick up information.

5. Select the payment method.

6. Once the order is placed, it will be displayed on the screen:

• b. Price.
• c. Indication of shipping cost if applicable.
• d. Delivery date according to the type of shipment chosen.
• e. Total value of the operation.
• f. Other conditions of the order.
• g. Possibility to print and store the order.
• h. Also a unique order number.

7. Sending the information to the registered e-mail address.

8. The order will then automatically go through an identity confirmation process, always safeguarding the security and privacy of the user and the contracting process, availability, validity and quota of the selected payment method.

9. Once the above is fulfilled, the contract is perfected by charging the selected payment method, after a stock validation of the products of the contract, the purchase receipt will be sent with the corresponding invoice and the product will be dispatched, according to the delivery method selected.

10. The purchaser's rights shall not be affected and no charges shall be made without confirmation of the purchaser's identity.

Unless a different means of payment is indicated for specific offers, the products and services reported on this site can only be paid by means of:

1. Bank credit cards Visa, Mastercard, Dinners Club International, Magna or American Express, issued in Chile or abroad, as long as they maintain a valid contract for this purpose with Roly Chile.

2. Bank debit cards under the Redcompra systemissued in Chile by domestic banks, which maintain a contract in force for such purposes with Roly Chile.

3. Mobile applications and prepaid cards.

Payment with credit and debit cards will be made through WebPay or WebPay OneClick, which is an electronic payment system that automatically debits the user's bank account.

Users declare that they understand that these means of payment or payment portals belong to third party companies that provide these services, independent and not linked to Roly Chile, so that the continuity of their provision of services over time, as well as the correct operation of their online payment tools and buttons, will be the sole responsibility of the companies providing these services and in no case of Roly Chile.

If the customer is not satisfied with his purchase and the product is new, unused, in perfect condition, without intervention of any kind, in its original packaging and with all its components and labels, then you can make the return of your purchase. The deadline to make effective this return is 10 days from the date of sale of the same and its refund will be made with the same means of payment used for the purchase within a period not to exceed 10 working days The customer will be informed of the acceptance of the return, which will be informed through the e-mail address registered. In the case of exchanges this period extends to 30 days, respecting the same conditions previously mentioned.

If the return or exchange does not meet any of the above conditions, it will not be received.

For sales made on the site roly.cl the customer must send his purchase, accompanied by the original invoice or receipt (shipping costs to be paid by the customer). Once the products have been received, the customer will be contacted to coordinate the exchange or refund, as he/she prefers.

This warranty does not apply to custom-made or made-to-order products. In the case of products that are reported as used, opened, second selection or with any deficiency, which are purchased having been informed of this situation in stores or site roly.cl and with a reduced price, no exchange or refund will be applicable.

The user will have a period of 10 days to terminate the contract concluded by electronic means as soon as he receives the product or contracts the service, before it is rendered.

To exercise this right, you must use the same means you used to enter into the contract and provided that Roly Chile has sent you communication of having perfected the contract, a complete copy, clear, understandable and unequivocal access to the general conditions of the contract and the possibility of storing or printing them.

If Roly Chile has not complied with the sending of the aforementioned written communication the term will be extended to 90 days.

This right may not be exercised when the good, subject of the contract, has deteriorated due to an event attributable to the consumer.

If the good or service was obtained by means of a credit, this is without effect, but the interest is charged to the consumer when it has been granted by a third party.

Roly Chile shall be obliged to return the sums paid, without retention of expenses, and as soon as possible and, in any case, before 45 days from the communication of the withdrawal. In the case of services, the refund shall only include those sums paid that do not correspond to services already rendered at the date of the withdrawal. You must return in good condition the packaging elements, user manuals, boxes, protection elements and any other element that came with the good.

If the product does not have the technical characteristics reported, if it is damaged or incomplete, it may be exchanged immediately. If the product is faulty or defective within the 6 months The customer may choose between free repair, or after restitution, exchange or refund of the amount paid, provided that the product has not deteriorated due to an event attributable to the consumer. It can be delivered directly to the Roly Chile branch located at Chiloé 1475, Santiago, Chile.

If the product is covered by a manufacturer's warranty, the term of this warranty shall apply, whichever is longer.

1. Products subject to mandatory safety or quality standards that do not comply with the specifications.

2. If the materials, parts, pieces, elements, substances or ingredients that constitute or integrate the products do not correspond to the specifications that they show or to the mentions on the labeling.

3. Products that, due to deficiencies in manufacturing, processing, materials, parts, pieces, elements, substances, ingredients, structure, quality or sanitary conditions, as the case may be, are not entirely suitable for the use or consumption for which they are intended or for which the supplier has indicated in its advertising.

4. If the supplier and consumer agree that the products covered by the contract must meet certain specifications and this does not occur.

5. If after the first time the guarantee has been made effective and the corresponding product has been exchanged, the deficiencies that render the good unfit for the use or consumption referred to in item 3 above still exist.

If the thing object of the contract has hidden effects or defects that make impossible the use to which it is habitually destined.

Product Dispatch

The conditions of dispatch and delivery of the products purchased may be chosen from the options offered on the site.

Buy online and pick up in store

If you choose to pick up the product in a store, you will be able to do so during the hours the store is open to the public. If you choose another pick-up point, you must follow the timetable indicated in the selected option.

Withdrawals must be made within a certain period of time, which must be duly indicated in each of the options offered. 2. Damages or eventual damages that may be caused to Buyers and/or Users by the operation of the search tools and errors generated by the technical elements of the Site or search engine.

3. Contents of the pages to which the Buyers or Users may access with or without authorization from Roly Chile.

4. Access by minors or persons without capacity, under the terms of the corresponding legislation, to the contents adhering to the contractual relationship arising from the Site.

5. Loss, misuse or unauthorized use of its validation code, either by the User and/or buyer Buyers, or third parties, after the purchase has been made in the manner expressed in the Terms and Conditions. Likewise, the parties acknowledge and state for the record that the computer platform provided by Roly Chile is not infallible, and therefore, during the term of this Agreement, circumstances beyond Roly Chile's control may occur, which imply that the Site or the computer platform may not be operative for a certain period of time.

6. Information of Roly Chile or its services found in sites other than Roly Chile. roly.cl

In such cases, Roly Chile will try to restore the Site and the computer system as quickly as possible, without being held responsible for any type of liability.

Roly Chile does not guarantee the availability and continuity of the operation of the Site and does not guarantee that, at any moment and time, Users may access the promotions and Offers of the Site.

Roly Chile is not responsible for viruses or other elements in the electronic documents stored in the computer systems of the Users. Roly Chile shall not be liable for damages caused to the Client, arising from the improper use of the technologies made available to it, regardless of the manner in which these technologies are improperly used. Roly Chile shall not be liable for damages caused to the Site by the improper and bad faith use of the Users and/or Buyers. However, in the event of a double payment by a User or Buyer on the Site, Roly Chile will return the amount of the overpayment, within 5 working days following the receipt of the respective written claim from the User or Buyer, in which the original receipts of the additional payment to what was purchased are attached.

In Login, registration and communication with payment companies, Roly Chile uses digital security certificates (SSL), in order to encrypt communication. Roly Chile does not manipulate or store financial data of its customers.

In any case, Roly Chile's liability, whether contractual, extra-contractual or legal, with the Users, Buyers or visitors of the Site shall not exceed the price actually paid by the Buyer in consideration for the product or service, without prejudice to what may be determined by the Courts of Justice.

Responsibility of Users with respect to the information registered on the site

Roly Chile will adopt the necessary and prudent measures to protect the security of the data and secret key, such as information encryption systems, security certificates or others that the company deems appropriate. In case changes are detected in the information you have registered in the site, or in case of any irregularity in the transactions related to your identification or the means of payment, or simply as a measure to protect your identity, our executives may contact you by telephone or e-mail, in order to corroborate your data and try to avoid possible fraud.

If we are unable to establish contact within 72 hours, for your own security, your order placed on our site cannot be confirmed. We will inform you by telephone or email that your order has been cancelled because we are unable to confirm your identity or the payment method offered. In addition, proof of the steps taken to contact you and confirm the transaction will be available in our offices for 30 days, so that you can confirm the purchase order. However, Users and/or Buyers are solely responsible for the loss, misuse or unauthorized use of the validation code, either by themselves or by third parties, after the purchase has been made in the manner set forth in the Terms and Conditions.

Personal data:

Users and/or Buyers warrant that the information they provide for the conclusion of the contract is true, complete, accurate and up to date.

In accordance with Law 19.628, the personal data provided on the Website will become part of a Roly Chile database and will be used solely and exclusively for the purposes for which they were provided and especially for general communication between the company and its customers, validating the purchase data, completing the shipment and answering your queries. The data will not be communicated to other companies without the express authorization of its owner and will not be transferred internationally.

Roly Chile never requests personal or financial data through e-mail.

Roly Chile presumes that the data have been entered by their owner or by a person authorized by the owner, as well as that they are correct and accurate. By accepting these Terms and Conditions, Users and/or Buyers state that the personal data provided through the online forms on Roly Chile's website may be used for subsequent offers other than those offered on the site.

Notwithstanding the foregoing, Roly Chile guarantees users the free exercise of their rights of information, modification, cancellation and blocking of their personal data established in Law 19.628. Therefore, purchasers may make requests related to such rights, and within a maximum period of two calendar days, Roly Chile must respond and effectively implement this request.

Data Processing

The purpose of collecting and processing personal data provided by users is to allow the management, administration and optimization of our services, always in relation to our terms and conditions. Considering the aforementioned, Roly.cl may process personal data to ensure the user's experience, provide web advice and answer queries, manage purchases, manage the user's account, verify identity, manage orders and returns, provide protection against fraud, manage promotions and campaigns without obligation to the user. With respect to the above, COMMERCIAL MUNDOTRANSFER SPA is responsible for the processing of users' personal data.

Electronic Documents

The user, as a manual recipient of electronic documents, in accordance with Exempt Resolution No. 11 of February 14, 2003 of the Internal Revenue Service (which establishes the procedure for taxpayers authorized to issue electronic documents to also send them by these means to manual recipients), declares and accepts the following:

By approving these terms and conditions, the user authorizes the company Mundo Transfer SPA Rut: 78.950.040-1, so that the corresponding tax document of this transaction, is delivered only by electronic means. Likewise, the user authorizes that the notice of publication of the tax document be sent by e-mail.

In accordance with the aforementioned regulations, and in the event that the user requires it to support the accounting information, the user assumes the following obligations in relation to said tax documents:

Print the documents received in electronic form, for each tax period, immediately upon receipt from the issuer.

2. Print the document in the size and form that was generated.

3. Use original white paper with a minimum size of 21.5 cm x 14 cm (1/2 letter) and a maximum size of 21.5 cm x 33 cm (legal size).

4. Print in a quality that ensures the permanence of the legibility of the document for a minimum period of six years, as established by the legislation in force on the matter. This printing shall be done using laser or inkjet printing, unless a different authorization or standard is established in this regard.

Roly Chile will not modify the conditions under which it has contracted with consumers on this site. As long as they appear on this site, the prices reported will be available to the user, even if they are not the same as those offered in other Roly Chile sales channels, such as physical stores, catalogs, television, radio, or others.

However, the prices are applicable for the city of delivery or dispatch. If once a product is added to the shopping cart, the delivery or shipping address is changed to a different city, the total price of the product will change according to the shipping costs to the new city registered.

Any change in the information published on this site, including those referring to goods, services, prices, stocks and conditions, promotions and offers, will take place before receiving a purchase order and will only refer to future operations, without affecting, in any case, rights acquired by consumers.

These terms and conditions are governed by the laws of the Republic of Chile. Any controversy or dispute arising from the use of Roly Chile's website, its Terms and Conditions and Privacy Policies, its validity, interpretation, scope or compliance, shall be submitted to the applicable laws of the Republic of Chile.
